DACA Guidance in Las Vegas
Current DACA Options for Recipients & Families
As of November 5, 2026, current Deferred Action for Childhood Arrivals recipients can seek continued protection from deportation and employment authorization, but DACA doesn’t grant permanent legal status. Federal litigation continues to affect the program. Heras Law Firm provides immigration representation throughout Nevada, carefully reviewing each person’s history and documents.
Current recipients can continue to request two-year renewals. USCIS isn’t processing initial DACA applications for approval at this time. A January 2025 ruling by the U.S. Court of Appeals for the Fifth Circuit found DACA unlawful, while the district court’s stay preserved existing protections for current recipients.
Miguel Heras leads our work guiding families, workers, and entrepreneurs through the federal legal system. Our fully bilingual, Spanish-speaking legal staff communicates directly with clients in their native language. We also maintain active admissions before federal immigration tribunals, the Executive Office for Immigration Review, and relevant state court jurisdictions.

DACA Renewal Requirements in Las Vegas
A renewal request requires three documents: Form I-821D, Consideration of Deferred Action for Childhood Arrivals; Form I-765, Application for Employment Authorization; and Form I-765WS, the economic worksheet submitted with the application. The information about identity, residence, travel, and prior immigration filings should be consistent across all three.
As of November 5, 2026, the principal filing details include:
- Online Filing: The total fee is $555, consisting of $85 for I-821D and $470 for I-765.
- Paper Filing: The total fee is $605, consisting of $85 for I-821D and $520 for I-765.
- Fee Waivers: USCIS doesn’t offer fee waivers for DACA renewal requests.
- Recommended Timing: USCIS recommends filing 120 to 150 days before the current DACA approval and work permit expire.
Who May Renew DACA
Renewal generally requires continuous residence in the United States since the applicant’s most recently approved request. The applicant also must not have departed the country without advance parole after August 15, 2012. Advance parole may permit certain noncitizens to travel abroad and request reentry without automatically abandoning a pending immigration benefit.
USCIS also considers criminal history, national security concerns, and public-safety issues. An arrest, charge, conviction, travel event, or change in immigration history may require closer review before filing. A previous approval doesn’t automatically resolve a new issue.
Careful Review of DACA Records & Filings
Legal guidance for a DACA-related matter may include determining whether renewal remains available, identifying required records, checking documents for consistency, and evaluating USCIS correspondence. A complete entry and travel history is particularly important because an unauthorized departure may affect a request. Prior applications, approval notices, work authorization cards, passports, and law-enforcement records may also be relevant.
We begin immigration matters with a thorough initial consultation. We review the person’s entry history and available documentation before outlining realistic legal paths. This review is especially useful when a client’s record includes travel, a prior immigration filing, an arrest, or facts that have changed since the last application.
Document Review & Agency Notices
We emphasize precise file preparation and tracking. For application packets we prepare, we audit the materials before filing to reduce avoidable administrative delays and petition rejections. We also communicate directly with clients as federal agencies, USCIS offices, and immigration court dockets process their cases.
USCIS correspondence requires prompt attention. A request for evidence identifies additional material needed to decide a filing and specifies a response deadline. Other notices may address biometrics, appointments, transfers, decisions, or procedural requirements, so each document and its instructions should be reviewed carefully.
Planning for Immigration Legal Costs
We offer structured monthly payment plans for immigration clients facing multi-step legal proceedings. During a consultation, we discuss the issue presented, the review it requires, and the available payment structure. Clients then have a clear basis for deciding how to proceed.
Why DACA Renewal Timing Matters
DACA generally must be renewed every two years to maintain its protections and employment authorization. Filing during USCIS’s recommended 120-to-150-day window gives the agency time to process the request before the current approval and work permit expire. Processing periods vary with agency workload, case details, and requests for additional evidence.
A late filing can create a gap after the current approval expires. During that gap, the person may lose DACA protection and authorization to work. Renewal doesn’t convert DACA into permanent residence, citizenship, or another lawful immigration status, so possible long-term options require separate legal analysis.
